I dont know specifically about Crytech allegedly altering their code, but games that use PhysX run upwards of 10x better on nVidia cards. Why? Because PhysX is a technology developed BY nVidia, but it is still something to consider (for instance Crysis and Mirrors Edge use PhysX)...

PhysX is a very nice feature. I would say SLI is probably much more superior to ATI (meh, not going to argue about it Tucker, just stating my opinion).
PhysX can also be used with two different nVidia cards, take for instance, the 9800GT and a 6600GT, dedicated the 6600GT to PhysX, or something like that. Still boosts it a fair amount. If I were you, I would go nVidia, but that's because I'm an nVidia fan and most benchmarks I've read (not using benchmark tools, but games and such) nVidia flat out beats ATI every time.
Just my two cents.

So if I had a PhysX game, with two comparable-spec cards from ATI and nVidia, except for the PhysX component, the ATI game would run at 40fps while the nVidia one would run at 400? Sweet!

Yeah way to misinterpret what I said. I've seen benchmarks of ONLY PhysX and the difference in performance (on that single component) was astounding, with nVidia outperforming ATI by around 800%+. although im considering crossfire with 4850s cause i found a few Esellers who have some good prices as far as 2 video cards go.....

You cannot compare a card that has more capability than another card against each other. Cards from nVidia and ATi were not designed to match in performance, with that stated, its unfair to put them head to head and say one company is better off because a certain nVidia card was better than a certain ATi card.
Look at quality and overall performance, not the performance of one random card against a somewhat equal card from a rivaling company.

HD 4850 vs 9800GTX
Both roughly 160 bucks but the 4850 is quite noticeably faster in all benchmarks.
