if i get Mimesis (which i already have) can i still use my xbox live account?

or will it get banned instantly for download user created DLC maps?

You'll probably get a matchmaking ban - if anything is modified under E\TDATA\4d530064\, it will probably detect that and ban you.

Just delete the maps that you downloaded/or put them on your computer for later use, then use xbl.

where does Mimesis store maps that are downloaded?

If you clear everything that isn't official from Halo2's Persistent Content folder (E\tdata\4d530064\) you won't get any bans.
If you cheat, or have modified or non-official content in Halo2's Persistent Content folder, you'll get a matchmaking ban. Still can do everything else. But MM bans don't leave much fun FYI.
