tread carefully and think it out. court action is a bad idea, but media attention sounds good. if you're in the south, or any conservative area, it'll be even better, because although it isn't illegal, it's immoral.
the picture wasn't serious, and it's an opinion, really ("making the wrong decisions the right way"), so i don't see any reason he should be punished.
i say first, try and talk to your administrators and either get the punishment removed or lessened, and if that's unsuccessfull, spread it all around school, and get word to the parents (angry parents calling the school gets annoying fast). if that doesn't work, threaten media attention (they don't want attention brought to them of any sort of sexual issue). and if that doesn't work, spread it around every single way you can. once the school gets enough bad publicity, they'll cave.

Media action would be best methinks.
The constitution says all "'men' are 'created' equally" through civil rights arguments this has been stretched to mean women and men of all races, yet it seems that everyone forgets the created part. I think that teenagers and children deserve equal rights because IMO 'created' could mean born.

since we have arms and we have the right to bear them this is no longer a legal matter. in other words stop copy and pasting stuff from the constitution or the bill of rights. this will only go as far as the school board no further. saying things to the degree of "media attention will aid your struggle" does not solve the "dilemma" here in this thread

ive seen somthing like this happen when i was at school years ago...
best bet is get media attention and tell the authority of the school you are seeking legal advice on the grounds of breach of human right of freedom of speach.
and if they say it is their property imporm them that it is the creators intellectural property and is copyrighted under that.
