Legal or not?

Ok, just today right after the dismissal bell rang I was walking out of computer class to the bus. I had headphones in my ears, plugged into my MP3 player, which also happens to be a jump drive that I use for all my school assignments. The MP3 player wasn't even on, I just had the headphones plugged in. Out of no where comes my dumbass principal and tells me to give it to him. Of course I do it, after getting on the bus (about 15 seconds later) I realize something, after dismissal, I thought that they had no jurisdiction over students. Recently a ban was placed on MP3 devices due to the fact that "they could be used for cheating" which is the dumbest thing I have ever heard, paper can be used for cheating, so why the hell don't they ban that :roll: My principal is probably not going to give it back, even though I need a USB drive for assignments due to the fact that I'm not allowed to use the school's internet because of what I did to their website. The last USB drive I had was stolen, and the principal chose not to do anything about it. I think this is very unfair, what about you?

Honestly, I think you should have just ignored him and walked out of the school, pretended the music was too loud to hear him. Doesn't sound like you're getting it back unless you convince your parents to go in and complain about it. They don't run the schools, the parents do.

I was thinking about that, but I've been in trouble 2 times already. Once for "defacing the school's website" and once for "sale of stolen goods on school property"

Almost everyone in the school has a jump drive, and of course the principal has seen them using MP3 players, both before and after the ban and gave them only a warning, multiple times. I'm thinking about complaining about discrimination.

What the hell, why would you let him take your mp3. They're not allowed to do that, it's people like you who make them think they can. Since you couldn't deal with it yourself you might as well get your parents to call and tell him to give that fuckin thing back.

So this is really all your own fault.

You shouldn't have fucked up the site and you shouldn't have had the headphones in when you knew there was a rule against it.

Doesn't matter. If you got banned from a shop, the store owner couldn't come and steal your shit. That thing is not the principals to take, at all. He

It's commonly accepted that school officials are able to confiscate items which break rules or are a 'nuisance item.'

While they don't have legal right to take anything from you, you are breaking the rules of the building and failure to give it to them would most likely result in something along the lines of suspension, which does fall under their jurisdiction.

Since you were technically still on the school grounds, they are allowed to take it. Next time maybe you won't be stupid about breaking the rules.

I pretty sure that's wrong cause at my school as soon as the bell rings we are allowed to use our Ipods, cell phones, skateboards on school campus and their not allowed to take them away.

I don't know, different school districts and schools have different rules. I would try to get my parents to help get it back for me. Or apologize to the principal and explain that you have school assignments on that.

I think they have the right to punish you or temporarily take your MP3 players away...they shouldn't be able to take it away forever. That's still stealing expensive material. They're not above the law, and there's no legal power that gives them the right to take your MP3 player from you permanently.

Anyways, the second you step onto school property, you lose your rights. There was a form of recognition for school rules that your parents or you signed at one point that basically says, "my child acknowledges the rules on the campus and agrees to go by them or ____".

When you're on their property, they nearly have complete jurisdiction over confiscation etc.

Paper is needed to take the test. An mp3 player is not.

I would have gave him my headphones and said there was no MP3 player hooked up. Actually thats what I do.
Yeah in my school were not aloud to listen to music, but we can have them. Same for cell phones.

I personally would of walked away. I would never let a teacher take a cell phone or mp3 player that I own. There's nothing they can really do....
