Modchips arnt ilegal, and even some of the software isnt illegal. I think for it to be illigal it has to have part of the the Xbox Dashboard, or some code on the xbox in the software

Nope, modchips are perfectly legal. It's the hacked bioses and the homebrew applications you put on them that are illegal. You can look at a modchip as just a piece of electronic equipment that is designed in a certain way that just happens to fit perfectly into an xbox console
