Modchip/hard drive question

I have a question about my hard drive and my xenium modchip. Is it possible to sign on to xbox live with that and not play matchmaking just play in parties(cuz my friend lives far away) and not get banned on xbox live? So basically if anyone knows any possible way to play with a modchip on live in parties and not get banned could u plz let me know cuz i really wanted to play with my friend. Thanks
