how could bungie sue him?
As wrong as this seems.... in all reality HCE is a free download, and you need HPC to play it. He's selling the add on to the game. He says that you need Halo PC to play it in his discription.
Sure it's lame, but hell same thing happens with all sorts of games like this. I've seen Stepmania disks go on ebay. (Stepmania is a free open source DDR remake. For more information go to www.stepmania.com ) They sell those disks online for a couple bucks. Sure he advertises it as "DDR WITH A BAJILLION SONGS" and all that, but it isn't really DDR.
